Excessive card surcharges to be banned by end of 2012

"Excessive" fees for using a debit or credit card to buy items such as travel or cinema tickets will be banned by the end of 2012, under government plans.

Local authorities and the DVLA also levy charges, as do many train, ferry, theatre and cinema ticket merchants.

"While the law will come into force at the end of 2012, we want companies to be upfront and fair over card charges today."

He hoped that the Irish government would work at the same pace as the UK government in implementing the changes, to cover traders and travel companies based in the Irish Republic.

The process of accepting credit or debit cards as payment is quite complex, although retailers point out that they absorb this cost in their sale price.

The OFT calculated that travellers spent £300m on card surcharges in the airline industry alone in 2010. Ryanair responded to the government's announcement by saying that it charged an administration fee - which also covered the cost of running the website - rather than a surcharge.

The OFT has been investigating some unnamed airlines over the "transparency and presentation" of their surcharges.

The government will launch a consultation at the start of 2012.

Flight booking charges, mobile phone call and data roaming charges are some of the more invasive hidden costs bourne by the modern independent travellers.

Making charges and costs more transparent, obvious and reasonable can only help, not the travellers incurring the costs, but also the industry who are often seen as being unfair and provoking expressions like 'ripped off'.

Scuba Diving Mallorca - New wreck planned

Plans are being discussed to create a new scuba diving attraction near Santa Ponsa just West of Palma de Mallorca.

Subject to approval by local authorities and other planning constraints, it is planned to scuttle an old decommissioned navy frigate close to Isla Malgrats just off the coast near Sant Ponsa, Mallorca.

Consideration has to be made to throughly decontaminating the vessel prior to sinking, but once scuttled it should soon become an attraction not only to human divers, but also to a wide diversity of sealife and form a basis for coral growth.

We understand the planned ship is to be the F71 Baleares (Wikipedia link for the Baleares Class Frigates). The F71 is one of five frigates built in the 1970's, this one was commissioned in 1973 and decommissioned in 2004.

Soller trams restored

Two trams which roll through the narrow streets of Soller, down narrow passages and past (also through) restaurants between the town of Soller and Port de Soller, have been carefully and lovingly restored.

The trams restored were two of the open carriage trams, this involved the replacement of almost all the wood whilst in the workshops near Soller; it is now possible to visualise them as they would have appeared when originally pulled through the streets by horses in the late 1800's.

Anyone visiting Mallorca would find a days visit to Soller very worthwhile.

If starting from Palma you can drive there either over the very steep and winding hill road, or through the much quicker direct tunnel; or you can catch the Soller Train from Palma which travels up the valley then through a long mountain tunnel emerging to spectacular views above the town, there is a short stop at a view-point before looping around on itself during its descent down into the town.

Once reaching the terminus station in Soller, the journey can be continued through the town on the tram, this takes you the final distance to the Port of Soller.

Spanish reinstate 120kph motorway speed limit

From 1st July 2011 the Spanish motorway speed limits are returned to 120kph (75mph), this is 4 months after the speed limits were reduced to 110kph at an estimated 250,000 Euro cost in reaction to Libya unrest & increasing oil prices.

The interior minister (Alfredo Pérez Rubalcaba) explained that through the 4 months an estimated 450 million Euros were saved. Presumably if a saving was made, there was a reduction in fuel duty/tax income was felt by the Spanish government, perhaps one could question the logic in the government spending so much (250k) in order to lose so much tax income ;-) !

WiMAX Broadband connects Marina Dor III complex with WiFi

New for 2011, the Marina D'or III complex of quality holiday rental homes is connected to high speed wireless broaband using the WiMAX service.

This new service replaces the previous older, less reliable and slower WiFi service provided via a community access-point sharing a centralised Vodafone G3 network connection and router.

The new system consists of a central antenna receiving the main signal transmitted using the area using the WiMAX system (the acronym meaning "Worldwide Interoperability for Microwave Access), then repeated across the complex and into the 20 houses via WiFi Repeaters and individual encryped security keys.

This new service has been eagerly awaited by the owners and holiday makers for some time as Telefonica have for some years been promising but failing to deliver landline based ADSL type broadband.

As the new installation provides a standard WiFi signal, the broadband Internet service can be used by computers, laptops, PDA's and Smartphones allowing holiday guests to stay in touch with home, business, friends etc. with eMail, Social networks like Facebook, and also with free phone calls using VoIP and Skype etc.

For those with a technical interest, below is a little additional information on WiMAX, this was reproduced from "WiMax.com - 4G Wireless Broadband Solutions":

WiMAX is an IP based, wireless broadband access technology that provides performance similar to 802.11/Wi-Fi networks with the coverage and QOS (quality of service) of cellular networks. WiMAX is also an acronym meaning "Worldwide Interoperability for Microwave Access (WiMAX).
WiMAX is a wireless digital communications system, also known as IEEE 802.16, that is intended for wireless "metropolitan area networks". WiMAX can provide broadband wireless access (BWA) up to 30 miles (50 km) for fixed stations, and 3 - 10 miles (5 - 15 km) for mobile stations. In contrast, the WiFi/802.11 wireless local area network standard is limited in most cases to only 100 - 300 feet (30 - 100m).

The more recent Long Term Evolution (LTE) standard is a similar term describing a parallel technology to WiMAX that is being developed by vendors and carriers as a counterpoint to WiMAX.

Spain reduces motorway speed limits

In reaction to increasing oil prices and unrest in Libya, speed limits on Spanish motorways have been reduced from 120kph (75mph) to 110kph (68mph).

Throughout Sunday 6th March, workers worked to cover the old 120 signs with 110 stickers, in excess of 6000 signs, a cost estimated to be in excess of 250,000 Euros.

The speed limit is planned to be reduced for only 4 months.

Travellers to Spain are warned to be aware of the new limits or risk on the spot fines.

Spanish court rules Ryanair's €40 charge illegal

Ryanair Charges Deemed Illegal

In a court case held in Barcelona on December 21st 2010, Ryanair’s policy of charging passengers for printing their boarding passes at check-in was deemed illegal.

A passenger took the budget airline to court over the charge Ryanair imposes, passenges have to pay € 40 Euros (approx £ 34 UK Pounds) if they have not printed it before arrival at the airport check-in, but the Spanish court ruled the Irish airline must print the documents for free.

The case was brought against Ryanair by a Spanish lawyer (Dan Miro Garcia) who was charged for a boarding pass last May.

Ryanair argued that passengers were always well informed of the conditions attached to their ticket purchases.

Ryanair are expected to appeal against the ruling.

There is on going pressure on airlines to include all charges in the advertised, headline, ticket prices, these include booking charges, payment charges, checkin charges, baggage charges, to list only a few.

Another great year for Mallorca holidays

September has arrived:
      - UK weather is starting to get chilly
      - Tree leaves are starting to go brown and fall
      - Autumn is almost upon us and
      - Winter feels like it is just around the corner.

Despite the global recession and apparent economic doom and gloom, the Balearic Island of Mallorca (also known as Majorca) has again enjoyed another fantastic year as a very popular and highly recommended holiday destination.

Although the year started with uncertainty due to volcanic ash clouds causing flight delays and disruption to many, with some less fortunate in hotel accommodation being dismissed to roam the streets whereas other more reputable & responsible accommodation providers allowed them to stay.

Ash clouds problems soon became a distant grim memory as the CAA authorities gained a better understanding of the problem, then provided better and more relaxed regulations allowing Mallorca to return to its normal ideal holiday destination, plus of course the rest of Europe and the world which also experienced similar disruption.

NATS (National Air Traffic Services) confirms news from the CAA

This is a massive reassurance for holiday and business travellers and reduces the worries and concerns when making bookings, it is reasuring that such major national authorities responsible for air safety have worked to get these new regulations & guidlines accepted, it gives the confidence that the changes are not finacially motivated as would be suspected had airlines or holiday organisations driven through the changes.

UK CAA Anounces progress minimising ash disruption problems

The UK Civil Aviation Authority annouced changes to the regulations on ash flying

On 17th May 2010 the CAA posted an update to their website in a document named:
"Further progress made to safely minimise ash disruption"

The text of this docment is:
The UK Civil Aviation Authority (CAA) today reports a positive outcome from discussions with airlines, regulators, and aircraft and engine manufacturers resulting in new measures to reduce airspace closures caused by volcanic ash. These new measures will be available from midday tomorrow.

A new area of operations can now be introduced that creates a ‘Time Limited Zone (TLZ)’ between the black ‘No Fly Zone (NFZ)’ and the red ‘Enhanced Procedures Zone (EPZ)’. Aircraft and engine manufacturers, based on new research and analysis, have agreed that it is safe to allow operations in the new zone for a limited time at higher ash densities than is currently permitted.

To operate in the new zone airlines need to present the CAA with a safety case that includes the agreement of their aircraft and engine manufacturers. UK airline Flybe is the first to achieve this and will therefore be able to use the new zone from midday tomorrow.

This means that areas of our airspace that would have previously been closed can safely open, further minimising flight disruption.

Announcing the change Andrew Haines, Civil Aviation Authority Chief Executive, said: “I’m pleased that the huge efforts we’re all making across aviation to keep flying safe whilst minimising the disruption from the volcano have resulted in further progress. Unprecedented situations require new measures and the challenge faced should not be underestimated. Firstly because the standard default procedure for aircraft that encounter ash, to avoid it completely, doesn't work in our congested airspace. Secondly, the world’s top scientists tell us that we must not simply assume the effects of this volcano will be the same as others elsewhere. Its proximity to the UK, the length of time it is continuously erupting and the weather patterns are all exceptional features.

"The answer can only come, therefore, from aircraft and engine manufacturers establishing what level of ash their products can safely tolerate. At an international aviation conference we held last Thursday, attended by all the leading airline operators this approach was welcomed and supported. The manufacturers are co-operating fully and urgently in this task and the new zone is an excellent example of how the industry should be working to move the issue forward and I commend Flybe for its work.

"It's the CAA's job to ensure the public is kept safe by ensuring safety decisions are based on scientific and engineering evidence; we will not listen to those who effectively say 'let's suck it and see."

The introduction of the Time Limited Zone is based on measurements collected from test flights through the current ash cloud over the past month, as well as on data and evidence compiled and analysed from previous volcanic ash incidents combined with additional analysis from manufacturers.

Operations in the newly established Time Limited Zone may be subject to time limits and increased maintenance practices. The new Zone’s area will be established using Met Office forecasts, and will be approved by the CAA before operations are allowed within it.

The CAA will maintain its focus on the public interest by bringing the industry together to facilitate safe operations. Already over the past month there has been much learning from the combined efforts of operators, manufacturers, NATS, other regulators, forecasters from the Met Office, volcanologists and research agencies and this will continue.

1. The previous limit set by manufacturers allowed aircraft to operate where the amount of ash was less than 2x10-3 grammes per cubic metre of air. The new Time Limited Zone allows limited flights through ash levels of up to 4x10-3 grammes. This doubles the safe operating threshold of ash acceptable by engines.

Flights resume to and from UK after volcanic ash cloud problems

The grounding of aircraft which started on Thursday 15th April (see report in The Guardian) was today (Tuesday 20th April) lifted (see report on BBC website) after keeping all aiircraft out of UK (and a large amount of European) airspace for the best part of 5 days.

The massive 'clean up' has started where airlines & tour operators have to return travellers to their homes, 10's of thousands of holiday tourists and business travellers have been stranded the world over as a result of the grounding.

End in sight to travel chaos?

Some airline have resumed flying marking the beginning of the end to the travel chaos caused by the volcano eruption.
Among the first flights were from Scotish airports and Northern England, some flights left other vities around Europe starting the massive task of returning those stranged back to their homes and normality.

There is a possibility another cloud ejected by the volcano is heading in the direction of the UK and is bringing into question whether the recovery will continue or if it will be stalled before it starts.

Iceland volcano causes mass travel chaos

Erupting Iceland Eyjafjallajökull volcano (Wikipedia info link) sends ash into the upper atmosphere causing worldwide disruption to 1000's of travellers.

More details can be found in Wikipedia with photos of the erupting volcano in April 2010, also maps showing how the ash clouds spread, plus dramatic YouTube video of Eyjafjallajökull eruption.

Aircraft jet engines are at risk of damage should they pass through some of the high altitude ash clouds being blown over Europe, as a precaution the CAA (Civil Aviation Authority) places restrictions in place grounding all aircraft across the United Kingdom; UK CAA Volcano News Page.

Mallorca was not alone in the massive resultant problems, it was not long before Palma de Mallorca airport was closed. As no flights were able to depart to large areas of Europe including the UK, travellers were left trapped in the airport terminal buildings.

Many hotels appeared unsympathetic to their guests as they simply continued packing their tourist guests off onto the transfer coaches to vacate them from their rooms.

With no flights from Palma, ferries to the Barcelona on the Spanish mainland soon filled leaving no alternative transport to leave any of the Balearic Islands.

Spanish Capital Gains Tax Rebate may be possible on sales between 1997 & 2006

If you sold a property in Spain in the period between 1997 - 2006 a recent ruling may be a significant benefit to you.

You may be entitled to a Spanish Capital Gains Tax Rebate

- BUT -

claims must be registered within 12 months of the ruling.

Between 1997 and the end of 2006 a UK citizen selling a Spanish property paid 35% CGT (Capital Gains Tax), but Spanish nationals paid only 15%!

The ECJ ruling confirmed legal arguments and states this overpayment contravenes European Community Treaty discrimination rules and confirm it should not have been charged by the Spanish Tax Authorities.

Therefore, you may be entitled to reclaim this overpayment, plus approx 6% interest annually from the moment you present your claim, subject to you meeting the requirements.

There is an estimated 90,000 people who could make a claim.

Make sure you don’t miss out;
claims must be registered within 12 months of the ruling!

BUT: Although time is of the essence, it is critical to make the claim in the right way;
because:
"any cases that are rejected for whatever reason, cannot file the reclaim again".

New Cala D'or Health Centre

Cala D'or gets a new 1.3 Million Euro Health Centre

Cala d'Or and the the locality benefits from a recently opened Health Centre; the centre was opened by the Minister for Health (Vicenc Thomas) together with the local Mayor (Miquel Vidal) earlier this year.

The new centre cost almost 1,300,000 euros and replaces the older facility in Cala D'or, it will provide improved working conditions for medical staff and more comfort for patients.

The new facilities have been designed to cope with the greatly increased workload during summer months when Cala D’or accommodates many with tourists.

Cala Mondrago nature reserve benefits from tree project

Mondrago Nature Reserve to benefit from tree planting project

The Mondrago Mallorca National Park is to benefit from a joint project between the Environment and Transport Minister (Gabriel Vicens) and Guillem Aulet (the head of private banking group La Caixa), to finance planting of trees on five separate tracts of land.

The plan is to plant about 600 trees, including almond, carob and fig, on public land in the Mondragó nature reserve as part of a scheme to recover the park’s agricultural heritage.

The scheme is just one of many organised by the joint venture to improve and conserve natural areas of the Balearic Islands, the planting work is to be carried out by long-term unemployed.
